Agreement to Terms

By accessing or using Tally ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

Description of Service

Tally is a mobile-first scorekeeper application for game nights. The Service allows you to track scores, manage game history, and share games with other users.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others
• Transmit any harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated systems to access the Service without permission
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

User Accounts

You may choose to create an account to sync your data across devices. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

User Content

You retain ownership of any content you create or upload through the Service. By using the Service, you grant us a license to store, process, and display your content as necessary to provide the Service, including syncing your data across devices and enabling shared games.

Shared Games

When you create or join a shared game, your display name and game scores will be visible to other participants. You are responsible for ensuring that any information you share in shared games is appropriate and does not violate these Terms or any applicable laws.

Service Availability

We strive to provide a reliable Service, but we do not guarantee that the Service will be available at all times or free from errors, interruptions, or security issues. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless Tally and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service is operated, without regard to its conflict of law provisions.
